When the new Scottish Secure Tenancy was introduced on
If however you move to another property you will lose your Right to Buy.
If you did not have the Right to Buy your home before
Tenants who have a Preserved Right to Buy and who choose to assign their tenancy to someone else cannot transfer the Preserved Right to Buy to the assignee.
If you succeed to a tenancy following the death of the tenant, the succession rights can be passed on in the following order:
· To a husband or wife
· To a joint tenant
· To a partner of the same sex or co-habitee who lived with the tenant as if they were married as long as their home had been his or her main home for at least six months.
Under the following categories a succession can take place, but with NO Right to Buy:

To another adult member of the family provide it has been their principle home

To a carer as long as:

he or she is aged at least 16 at the date of death

the house was his or her only or principle home at the date of death

he or she gave up another only or principle home before the death of the tenant
-
he or she is providing, or has provided, care for the tenant or a member of the tenants family
