How Do I

Right to Buy

If you were previously a Scottish Homes tenant prior to 29 January 1997 and still stay in the same house, you will retain the Preserved Right to Buy.

 

When the new Scottish Secure Tenancy was introduced on 30 September 2002, you will continue to have the same Right to Buy with the same discount you would have been entitled to.

 

If however you move to another property you will lose your Right to Buy.

If you did not have the Right to Buy your home before 30 September 2002, you still do not have the Right to Buy your home.

 

Tenants who have a Preserved Right to Buy and who choose to assign their tenancy to someone else cannot transfer the Preserved Right to Buy to the assignee.

 

If you succeed to a tenancy following the death of the tenant, the succession rights can be passed on in the following order:

 

·         To a husband or wife

·         To a joint tenant

·         To a partner of the same sex or co-habitee who lived with the tenant as if they were married as long as their home had been his or her main home for at least six months.

 

Under the following categories a succession can take place, but with NO Right to Buy:
